Major question is, can Congress delegate a power they themselves dont have. scotus must decide whether government can seize penumbra of liberty interest being that interest is a manifest of God not government if the courts decision is yes, it will in doing so, label government as an equal to God, crumbling the essence of our systems foundation. the right argument needs to be submitted, it cannot cause economic detriment, and it needs to be done before economic detriment from this child welfares existence becomes economically detrimental. agencies functioning on a corporate model is the flaw. If we inverse incentives to clearly target congress intent, it would self correct. To not implement with time and language being excuse of Congress means maybe congress shouldn't pass ambiguous unclear orders out.
